Processing of personal data

WebConcept takes the protection of your personal data very seriously. The way the data is processed intends to limit the processing of your personal data to what is strictly necessary for an efficient and economical use of our offer. WebConcept assures you that your data will be processed in an honest, transparent and informed manner, according to the EU General Data Protection Regulation no. 679/2016 (“GDPR”).

This is why the company has decided to inform you through this Personal Data Processing Policy (“Data Processing Policy” or “Policy”) regarding:

WebConcept (the “Agency”) will have the same approach every time you visit the website. This Data Processing Policy may be modified or updated at any time, when the Agency considers that certain changes occurred in the activities through which personal data is processed. The changes will be posted on the Site and you will be informed accordingly by e-mail.

Who are we?

Rave Painter’s Shop UG, d.b.a WebConcept, German legal person, registered at the Trade Register under no. HRB 723958 having a unique fiscal registration code 11090/32272 and VAT number DE 342128189 is the operator of your data and the entity that supplies you with goods through the website.

What is personal data

Personal data means any data or information that helps to identify the customer directly (i.e first and last name, date of birth, home address) or indirectly. Some information is less obvious (such as your shopping preferences and habits, computer’s IP), but that if associated helps to identify the person and thus circumscribe the notion of “personal data”. In general, following type of personal data is processed by the company:

  • First and last name

  • Email Address

  • Phone number;

  • Billing and shipping address

  • General geo-location of the device from which the customer authenticates in the client account;

  • Information about the purchased products and services;

  • The degree of use and the customer’s activities on the platform;

  • Customer’s interests and preferences.

WebConcept does not allow the processing of personal data of minors (under the age of 18). In the process of creating an account or placing an order on the website, the customers must confirm that they have reached the age of 18.

What personal data is processed?

If the user is browsing the website for information purpose only, without logging in, creating an account or contacting the Agency, following data may be collected, saved and/or processed:

  • IP address of the calling computer, date and time of access

  • name and URL of the file viewed

  • browser used

  • number of bytes transferred status of the page viewed

  • Session ID

  • Referral URL

The collection and processing of this data is carried out in order to allow the use of the website (establishment of the connection), to ensure the lasting system’s security and stability and the network’s infrastructure technical administration. In addition, this data is analysed for internal statistical purposes and in order to improve the supply and is then deleted. This assessment is done by an external service provider, so that the company received only anonymized assessments, which does not identify the person.

As part of processing behalf, a third-party provider provides the Agency with website hosting and presentation services. This serves to protect the Agency’s legitimate interests in the correct presentation of its offer, which predominate in the context of a balancing of interests. All data collected in connection with the use of this website or in the forms provided for this purpose on the website are processed on its servers. Processing on other servers only takes place within the framework described here.

This service provider is located in a country of the European Union or the European Economic Area.

If the customer uses the website and places an order, his/her personal data which is necessary for the processing of the order and for customer service (name, address, e-mail address, order data, payment data, customer number, telephone number, IP address) as well as the data that communicated by the customer on a voluntary basis is collected and processes. This data is required for the processing of orders and payment and will therefore be processed in this context. This allows the optimally and quick fulfilment of the order. If the customer refrains from providing the data necessary to process the order (name, address, email address, order data, payment data, customer number, telephone number), the Agency will not be able to fulfil the order.

Mandatory fields are marked as such, because in these cases the data is needed for contract processing, customer account opening and/or order shipping. The data collected can be viewed from the respective input forms and is used according to GDPR and country laws for the requests and order processing. After completing order and/or requests, processing or customer account deletion, the respective data use will be restricted to further processing and deleted after expiry of the retention periods under tax and commercial law. Any further use of the data will be done only with the person’s express consent. The deletion of the customer account is possible at any time and can take place by the account owner by sending a message to the contact address hello@webconcept.dev or by using the function provided for this purpose in the customer account.

How is personal data collected and processed?

WebConcept collects and processes your data to fulfil the orders you place and to deliver the products you want, improve your experiences in the Agency, provide assistance and support when using the Agency website / customer account, or to create a customer profile in order to send personalized offers (direct marketing).

When sending to the customer personalized offers through direct marketing channels (SMS, e-mail, push-up notifications) certain “profiling techniques” may be used, respectively a way of automatic processing data consisting mainly in the analysis and interpretation of collected customer information, necessary to evaluate or predict some aspects related to customer’s preferences, shopping interests, etc. For profiling purposes, WebConcept does not process sensitive data regarding sexual orientation, religious beliefs or political affiliations.

Customer’s behaviour and personal shopping preferences are reflected in the visit and/or shopping history, the use of the mobile app and other personal interests the customer may have.

According to customer’s consent, based on the data processing, the Agency may send you:

  • personalized offers based on online behavioural advertising;

  • personalized offers based on the profiling done for direct marketing purposes, through SMS communication channels, email and push-up notifications;

  • offers based on personalized audiences (on customer lists) on Facebook.

* Consent – means free, specific and informed consent by which the person accepts without a doubt that his/her data will be processed by the company for the purpose for which the consent is given. In the Agency, the consent is expressed by the action to tick the relevant box associated with the purpose and means of information processing specified in this Information Note.

How long is personal data stored?

WebConcept will keep the data only as long as the customer has an active customer account and / or continues to shop in the Agency. If the customer deactivates his/her account in the Agency and/or explicitly requests to the Agency the total account deletion, the data associated with the customer account will be deleted or anonymized so that identification in the data tracking systems is impossible, unless the company is obliged to maintain these data for a longer period according to the law, for reporting to public authorities, or to defend our rights in court. This is how the company ensures the customer’s full control over own data.

Who is personal data shared with?

Personal data may be transmitted to and processed by WebConcept trusted partners to provide the customers with products.

In order to provide to the customer with the products, personal data may be shared with the company’s reliable partners. The partners and suppliers are carefully selected and perform, on company’s behalf, operations in support of the business. Only the personal data necessary to carry out the specific entrusted activities is shared with them.

When certain activities are outsourced to the company’s trusted partners, every reasonable effort is made to verify in advance whether they ensure the protection of personal data through strict data security measures and to conclude with each partner a data processing contract.

Specifically, some data is transmitted to third parties (the Agency's suppliers and partners) to perform the functions and services necessary to operate the Agency’s activities, insofar as this is necessary for the delivery of the ordered goods.

Depending on the payment service provider selected in the order process, the payment data collected for payment processing is transferred to the credit institution responsible for the payment and, where applicable, to the payment service providers mandated or to the selected payment service. In some cases, the selected payment service providers also collect this data themselves if the customer creates an account there. In this case, the customer must log in to the payment service provider with his/her access data during the ordering process. The data protection declaration of the relevant payment service provider applies in this regard.

When is personal data transferred outside the European Union or EEA?

WebConcept may use payment and shipping service providers based in a country outside the European Union. The transmission of personal data to these companies takes place only in the context of the need to perform the contract.

What security measures are implemented for the protection of your data?

WebConcept provides the technical and organizational measures necessary for the safe collection, processing and storage of data, including against unauthorized access, unauthorized use of data, or destruction, loss or alteration of data. The company is committed to keep your personal data safe and take all reasonable safeguards to do so.

The company implements systematic processes for training people responsible for IT security and for monitoring and auditing the security of IT systems and infrastructures according to the WebConcept internal policies.

In addition, every reasonable effort is made to ensure (including through contracts) that company’s trusted partners also manage appropriate technical and organizational measures for the processing of the data shared with them.

All data that the customer transmits to the Agency is protected by Secure Socket Layer (SSL) encryption. SSL is a protocol developed to allow secure transmission of data over the Internet. SSL uses the Public-Private-Key procedure. Thus, data encoded with a public key can only be decrypted with a specific private key.

What are the customer’s rights and options regarding the processed personal data?

The customer benefits, if and to the extent provided by the applicable law, from the following rights with regard to the aforementioned persons in charge:

  • the right to access his/her personal data free of charge, to obtain a copy of this data as well as a right to obtain information, in particular as to their origin and recipients and the purposes and duration of the processing;

  • where applicable, a right to rectify inaccurate or incomplete data, erasure or limit its processing;

  • the right to oppose their processing, provided that it takes place on the basis of a legitimate interest of the controller and that he/she sets out the reasons for object to their processing (article 21 GDPR, if applicable);

  • the right to portability of personal data to request that it be received or transmitted to another controller;

  • the right to manage the access, rectification or direct deletion of some data available in the customer account in the Agency's website;

In addition, if and to the extent provided by the applicable law, the customer has the right to lodge a complaint with a supervisory authority, for example in the state in which the responsible person is domiciled, or ” State of your place of residence, your place of work or the place of the infringement (article 77 GDPR, if applicable).
